This Privacy statement explains how Rakeen, collects, processes, uses, protects, and disposes of your Personal Data. Rakeen is committed to complying with the provisions of the Personal Data Protection Law in the Kingdom of Saudi Arabia, issued by Royal Decree No. (M/19) dated 09/02/1443 AH, corresponding to September 16, 2021, and amended by Royal Decree No. (M/147) dated 05/09/1444 AH, corresponding to March 27, 2023, and its implementing regulations when processing your Personal Data for the purposes outlined in this statement. "Personal Data" refers to any information relating to you or that allows other individuals to identify you. This includes information such as your name, address, and telephone number.

Types of Collected Data

Payment Information

Rakeen collects certain payment and billing information when the User registers for certain paid services or products, Rakeen collects specific payment and billing information required to process the User’s purchase orders.

Automated Collection of User’s Data by Rakeen

Rakeen may collect data automatically from the User when they use Rakeen’s services or products. Such data includes:

  • Data contained in activity logs, billing, usage volume and statistics.
  • Data such as IP addresses, details on the User’s browser and/or device, such as screen size, screen resolution, and region (i.e., to choose the proper language).

Personal Data Protection

Rakeen is committed to taking the necessary regulatory and technical measures to protect your Personal Data from leakage, damage, or unauthorized access. In addition, sharing of your Personal Data will be limited to authorized employees and any other third party under the purposes described in this Privacy Policy.

Use of User’s Personal Data

Sharing Data with Controllers and Processors

Rakeen may share the Personal Data it collects with trusted suppliers, service providers, and subcontractors who are carefully selected to process data on Rakeen’s behalf. Rakeen is committed to ensuring that sharing of data with any third party working with Rakeen (controllers or processors) is based on legal ground. Rakeen might share the User’s Data depending on the type of information:

  • With User’s consent: Rakeen may disclose or share the User’s information after obtaining the required consent from the User. Rakeen may obtain the User’s consent in writing; online, or through “click-through” agreements
  • In a business transfer: Rakeen may disclose or share Users’ data as part of a corporate business transaction, such as a merger or acquisition, joint venture, corporate reorganization, financing, or sale of company assets, or in the unlikely event of insolvency, bankruptcy, or receivership, in which such information could be transferred to third parties as a business asset in the transaction.
  • To non-affiliated Third Parties: Rakeen may disclose or share Users’ data with certain Third Parties to facilitate Users’ access and use of Rakeen’s websites and services, including, but not limited to, Internet service providers, data analytics providers, governmental entities, operating systems and platforms providers, service providers who provide Rakeen with a service (e.g., credit/debit card processing, billing, shipping, repair, customer service, auditing, marketing, debugging to identify and repair errors that impair existing intended functionality on Rakeen’s websites, and/or protecting against malicious, deceptive, fraudulent, or illegal activity). Rakeen does not share sensitive Personal Data with Third Parties for marketing purposes. If Rakeen collects or processes Personal Data for research or statistical purposes, such data will be anonymized prior to its collection or processing.
  • To subsidiaries and affiliates: Rakeen may disclose or share Users’ information with Rakeen’s subsidiaries and affiliates to further facilitate the use of Rakeen’s websites and services for Users, identify and repair errors that impede intended functionality, and protect against malicious, deceptive, fraudulent, or illegal activity.

Cookies

  • Rakeen may use cookies, beacons, pixel tags, scripts, and other similar technologies from time to time to support the functionality of Rakeen’s websites.
  • Cookies are transferred from Rakeen’s websites to the User’s computer, phone or tablet, which allows Rakeen to identify the User’s device whenever they return to Rakeen’s websites.
  • These technologies provide a better experience when the User utilizes Rakeen’s websites, and allow Rakeen to improve its services. Rakeen uses session-based cookies that last only for the duration of the User’s session, and are used to keep track of the User’s sessions in an effort to balance server usage. Cookies do not contain information or data that may identify the User.
  • Rakeen also may use persistent cookies, but not to identify the User or to track their usage of other websites. The User may opt out of accepting cookies, and may disable cookies altogether by modifying their individual preferences on their web browser.

Personal Data Storage and Disposal

All collected data is securely stored using the highest security standards to protect against unauthorized access, modification, or disclosure. Rakeen will keep Users’ Personal Data for as long as it is necessary to fulfill the purposes for which it was collected or as required by law. Once the purposes are fulfilled and there is no longer need for the data, your data will be securely disposed of in accordance with the applicable regulations and best practices.

Transfer of Personal Data Outside the Kingdom of Saudi Arabia

Rakeen shall comply with Saudi Data and AI Authority’s regulations related to the transfer of Personal Data outside the Kingdom, including:

  • Purposes for transferring or disclosing Personal Data to entities outside the Kingdom.
  • Procedures and standards for evaluating the level of Personal Data protection outside the Kingdom.
  • Cases in which Controllers are exempt from the requirements to comply with the appropriate level of protection and the minimum transfer of Personal Data.
  • Subsequent transfer of Personal Data.
  • Revocation of exemption.
  • Risk assessment of transferring or disclosing Personal Data to a party outside the Kingdom guides and guidelines.

Your Rights Under the Personal Data Protection Law (PDPL)

  • Right to be informed: You have the right to be informed about the legal basis and the purpose for collecting your Personal Data.
  • Right to access: You have the right to access your Personal Data via our approved channels.
  • Right to request obtaining your Personal Data: You have the right to request a copy of your Personal Data in a readable and clear format.

  • Revocation of exemption.
